Polish 800+ Child Benefit in 2026: New Conditions Are Already in Effect, and from June the Requirements Will Be the Same for Everyone
The Rodzina 800+ programme - a monthly child benefit - remains available to foreigners legally residing in Poland. However, from 2026 the state has significantly changed the conditions for receiving it, and these changes were introduced in stages. Understanding this sequence is important both for those who are already receiving the benefit and for those who are just completing the paperwork or planning to change their legal status.
What Is in Effect from February 2026
The Social Insurance Institution (ZUS - Zakład Ubezpieczeń Społecznych) officially announced that from 31 January 2026, the 800+ payment for persons holding UKR status is automatically suspended. To reinstate it, a new application had to be submitted from 1 February 2026. These changes apply exclusively to persons with UKR status - approximately 150,000 people residing in Poland in connection with the armed conflict in Ukraine.
The new application must confirm:
- the PESEL numbers of the applicant and the child;
- data concerning the border crossing;
- the legality of residence in Poland;
- fulfilment of the active employment condition in the month preceding the submission;
- the fact that the child is attending a Polish school or kindergarten.
ZUS verifies employment data automatically through insurance registers - in most cases, no additional certificates from the employer are required. If ZUS has doubts regarding the place of residence, employment or the child's school attendance, it has the right to suspend the payment.
What Counts as Active Employment
According to the official ZUS list, active employment includes:
- work under an employment contract (umowa o pracę) or a civil law contract (umowa zlecenie);
- conducting business activity;
- receiving a scholarship - sports or doctoral;
- receiving unemployment benefit or participating in training with a scholarship.
For most forms of employment, the basis for pension insurance contributions must amount to at least 50% of the minimum wage, and for certain forms - at least 30%. The full list with thresholds is available at zus.pl.
An exception has been made for two categories to which the employment condition does not apply: parents or guardians of a child with confirmed disability, and persons applying on behalf of a child who is a Polish citizen.
What Changes from 1 June 2026 - Official ZUS Statement
ZUS officially announced that from 1 June 2026, the same requirement of active employment applies to all other non-EU and non-EEA foreigners legally residing in Poland who have access to the labour market.
The practical significance of this change: any non-EU foreigner legally residing in Poland who applies for 800+ after 1 June is subject to the same employment requirements as current UKR status holders.
What This Means for Those Who Have Applied or Plan to Apply for the CUKR Card
From 4 May 2026, Poland opened the possibility of applying for the CUKR residence card - a three-year residence permit for persons with PESEL UKR status. Under the CUKR legislation, the holder of this card retains the right to 800+ and other social benefits - but no longer under the temporary protection framework, rather on the general terms applicable to foreigners.
Since the CUKR card is a residence permit for a non-EU foreigner with access to the labour market, from June 2026 its holders are subject to the same active employment condition.
Advice from Gremi Personal
Submit a new application if you have not done so since February
If you hold UKR status and were receiving 800+ before February 2026, but have not yet submitted a new application - the payment is currently suspended. An application can be submitted via pue.zus.pl or in person at a ZUS branch. The benefit is not paid retroactively.
Official employment is not just about the residence card
Official employment with contributions paid to ZUS simultaneously opens access to 800+, NFZ and social protection. If for any reason the employer does not pay contributions on time - ZUS will not find confirmation of activity and the application will be rejected. Your insurance record can be checked through your personal account at pue.zus.pl.
